Terms and conditions
Clear agreements. Effective collaboration.
This is the draft version of the terms and conditions for Your Johnny, part of Johnny’s Mercantile.
The current registered trading names and legal details are still to be confirmed. Before a paid agreement, we confirm the specific arrangements and provide this information and the applicable terms in a form you can keep.
1. Who are you making agreements with?
In the case of direct sales, Your Johnny is the seller. For paid search and advisory services, Your Johnny provides the service. In the case of a direct agreement with an external maker or seller, that party carries out the assignment. Your Johnny remains responsible for its own activities.
The order confirmation clarifies who is supplying what. An introduction does not change the identity of the seller. View the three routes in the shop policy..
Draft terms: this text has not yet been finalised. You receive the applicable terms before a paid assignment.
2. A proposal first, then your approval
An initial inquiry, sample photo, WhatsApp message, or completed preparation form does not in itself constitute an order or a paid search assignment. An assignment only begins once the scope, contracting party, price, and relevant terms are clear and you have agreed to them.
We establish the product or services, known limitations, price (including any VAT), additional costs, payment arrangements, and expected delivery or duration in advance. Any required down payment and the payment term are specified in your proposal beforehand.
3. Searching and advising
€49.00 per hour, including VAT.
We agree on requirements, sizes and dimensions, color, material, style, new vs. second-hand status, non-negotiable criteria, preferences, and the maximum product budget. The rate and the maximum search hours or search budget are specified separately alongside these details. Additional time or extra costs require prior consultation and approval.
The service consists of diligent search and advisory work and does not guarantee a successful find, availability, a purchase, or acceptance by a maker. Payment for work performed is due in accordance with the agreed terms and applicable consumer regulations. You decide for yourself whether to purchase a proposed product.
Read the full explanation of the search and advisory service, including the terms regarding the hourly rate.
4. Product, Custom Made, and delivery
We discuss any known signs of use, characteristics, and uncertainties prior to purchase. Locating an external offer does not constitute a reservation. Agreed delivery or execution details will not be changed without notice; we will discuss any changes with you.
We discuss dimensions, material, color, hardware, finish, design, budget, and expected delivery time in advance. Feasibility, execution, price, and delivery time vary by assignment and are determined on a case-by-case basis; there is no fixed price or fixed turnaround time. The maker confirms what is technically and practically feasible. If you commission an external maker directly, their terms and conditions apply in addition to your statutory rights.
For products manufactured specifically to personal specifications, the statutory right of withdrawal may not apply in certain circumstances. Merely selecting from standard sizes or options does not automatically exclude the item from this right. Statutory rights regarding defects remain applicable. We will discuss any applicable exceptions before you place your order.
An assignment begins with your wishes. What do you want to wear, what will you use it for, what are your measurements, and what look do you want to achieve? An existing garment can serve as inspiration or a practical starting point, but it is not required: you can also begin with just an idea, a sketch, or a measurement.
An example is a reference for your wishes, not an instruction to copy. We do not make exact copies of protected designs or brands. We can make a piece suited to your function, fit and finish. We discuss permitted changes and the boundaries of a protected design with the maker beforehand.
You decide for each assignment whether your existing piece is to be preserved, partially replicated, or used solely for reference. Nothing is set in stone until you have discussed it with us and the maker.
5. Cooling-off period, returns, and defects
Statutory consumer rights remain applicable. The rules differ depending on whether the sale is direct, a paid service, a direct external purchase, or a custom-made item specified to your personal requirements (Custom Made).
The return policy outlines the practical details and conditions for commencing a service during the cooling-off period. The absence of a guaranteed outcome does not absolve Johnny of responsibility for ensuring work is carried out with due care.
6. External partners
Your Johnny brings people together: craftspeople who master their trade. Johnny can advise, introduce and help you get your question clear.
When you do business directly with an external partner, the agreements about that commission are between you and that partner. In that case, the partner is responsible for their own quotation, price, payment, measurements, choice of materials, production, and execution. Delivery times, shipping, warranties, repairs, complaints, and refunds are also part of that separate agreement.
Your Johnny may assist with communication where reasonably possible but does not thereby assume the external partner’s obligations. Your Johnny remains responsible for its own work and advice.
Are you purchasing the product directly from Your Johnny, even if another maker produces it? In that case, Your Johnny remains your seller. We will specify which situation applies in advance.
7. Privacy and respect
We only use information necessary for your inquiry or order. Publishing customer photos, names, stories, or completed work requires separate prior consent. Explicit fetish and BDSM commissions are exclusively for adults aged 18 and older.
Privacy & discretion explains what you do and do not share.
8. If something goes wrong
Report any problem with a product or service provided directly by Your Johnny to us. We will discuss the facts and a suitable solution, without prejudice to your statutory rights. For a commission contracted directly with an external party, please address the relevant partner first.
These terms and conditions do not limit any rights you have under the law. How to file a complaint.
